If you recently moved to Indiana and are considering a divorce it is important to understand the residency requirements for filing for a divorce in Indiana. To be eligible to file a divorce action in Indiana, for six months immediately preceding the filing of the petition for dissolution of marriage, at least one (1) of the parties to the Indiana divorce action must be a resident of Indiana or stationed at a United States military installation located in Indiana. If one of the parties meets the test listed above, the petition for dissolution should be filed in the county of residence where one of the parties has lived for the past three (3) months.
